What you can expect from Speedy Flow, and what we expect from you: your account, license, acceptable use, plans, referral program, and responsibilities.

1. Purpose and acceptance

These terms of use (the "Terms") govern access to and use of the Speedy Flow app, the Speedy Flow account, the referral program, and this website, published by Otopcy LLC ("the publisher," "we," "us"). By installing, opening, or using Speedy Flow, or by creating an account, you accept the Terms without reservation. If you do not accept them, do not use the Service.

They should be read together with the privacy policy, the cookie policy and, for paid plans, the terms of sale (the "Terms of Sale") and the refund policy. In the event of a conflict on a matter related to the sale, the Terms of Sale prevail.

2. Definitions

  • Service: the Speedy Flow app, its features (dictation, rewriting, meeting notes, Speeds, Transformations, Scratchpad, etc.), the online services that power them, and this website.
  • User or you: any person who uses the Service, for personal or professional purposes.
  • Account: the personal space created with your email address or your Google account, which holds your plan, your usage counters, and your referral code.
  • Plan: the Free plan, the Pro plan, or a Teams plan, as described on the Pricing page.
  • Content: everything you dictate, write, record, or produce with the Service.
  • Referrer, referee, and free months: the terms of the referral program described in Section 10.

3. Access to the Service

The Service is available on Macs with Apple silicon, running a version of macOS stated on the website. The iPhone, Apple Watch, Windows, and Android versions are announced as "coming soon" and are not yet offered. An internet connection is required for transcription and Speedy features.

You must be of the age required by the law of your country to accept these Terms (at least 13, 15, or 16 depending on the country, with a parent's consent if needed). If you use the Service on behalf of an organization, you represent that you are authorized to bind it.

You are responsible for your hardware, your connection, the permissions granted to the app in macOS (microphone, accessibility, calendar), and backing up your local data.

4. Your account

  • Creation: the account is created from the app, with your email address or your Google account. You agree to provide an accurate address that you check, and to keep it up to date.
  • One account, one person: the account is personal. You may not share it, resell it, or create multiple accounts to get around a plan's limits or multiply referral benefits.
  • Security: you protect access to your Mac, your email, and your Google account. Any activity carried out from your account is deemed to be done by you, unless you promptly report unauthorized use to us.
  • Deletion: you can request deletion of your account at any time, from the app or by email. Deletion ends your plan, your unused free months, and your referral code, with no refund for periods already started unless the refund policy provides otherwise. Your local content stays on your Mac.

5. Plans, limits, and fair use

The Service is offered in several plans, including a Free plan and a Pro plan. Their content, prices, and usage limits (number of words dictated, number or length of meetings, included features) are described on the Pricing page and in the app, which are authoritative as of the date of your use.

  • Limits may change. The publisher may adjust the Free plan's limits, the features included in each plan, or their thresholds. A change that is unfavorable to a current paid plan will be announced to you in advance and will apply only from the next period; you may cancel before it takes effect.
  • Limit reached: when a limit is reached, the feature concerned is paused until the next period. You can upgrade to a higher plan at any time.
  • Fair use: "unlimited" plans are unlimited for normal human use, personal or professional. Automated use, resale, or a clearly abnormal volume unrelated to individual use may be limited after notice to you.
  • Paid plans: payment (card, PayPal, or Mobile Money), renewal, cancellation, and withdrawal are governed by the Terms of Sale; refunds are governed by the refund policy.

6. Artificial intelligence and accuracy

Transcription, rewriting, summaries, and answers rely on artificial intelligence, including through third-party providers. These outputs may contain errors, omissions, or inaccurate interpretations. You must review them before any important use, especially in medical, legal, financial, or safety matters.

Speedy Flow is a writing aid. It does not provide any professional advice and does not replace a doctor, a lawyer, a certified translator, or an expert.

7. License to use

Subject to your compliance with the Terms, the publisher grants you a personal, worldwide, non-exclusive, non-transferable, and revocable license to install and use Speedy Flow on devices you own or control, for as long as you use the Service. You may not:

  • copy, modify, translate, or create a derivative work of the software;
  • decompile it, disassemble it, or extract its source code, except where expressly permitted by law;
  • rent it, resell it, sublicense it, or make it available to third parties as a service;
  • access Speedy Flow's online services other than through the app, for example through a script or an unofficial interface;
  • circumvent its limits, security measures, quotas, or the referral program rules.

8. Acceptable use

You agree to use the Service in compliance with the law and the rights of others, and in particular to:

  • inform participants and obtain their consent before transcribing a meeting or a call, as required by law in many countries (including US states that require the consent of all parties);
  • not record a conversation without the knowledge of the people involved;
  • not produce or distribute content that is unlawful, defamatory, hateful, or violent, or that infringes the privacy or intellectual property of others;
  • not use the Service to deceive, harass, commit fraud, unlawfully collect data, or develop a competing product;
  • not send bulk unsolicited messages to promote your referral link;
  • not disrupt the Service, test its security without written authorization, or use it in an automated and abusive way.

You are solely responsible for how you use the Service and for the Content you produce, transcribe, or distribute. If you discover a security vulnerability, write to us: we handle every report in good faith.

9. Your content

Your Content remains your property. It is stored on your computer and the publisher does not retain it. To operate the Service, you authorize its occasional technical processing, in particular the encrypted transmission of audio and text to transcription and writing engines, solely to provide you with the requested result. This authorization does not give the publisher any right to reuse or publish it.

No training without your consent: your Content is not used to train or improve models. The only exception, which is your choice: if you turn on the "Help improve Speedy Flow" setting (off by default), the app shares pairs of words as heard and as corrected, never audio or full text. You can turn it off at any time.

You represent that you hold the rights and authorizations required for the Content you process with the Service, including the voices and statements of the people recorded. You are responsible for backing it up: the publisher cannot restore data it does not hold.

10. Referral program

The referral program is reserved for people who already use Speedy Flow: it is available only in the app and lets you give and earn months of Speedy Flow Pro. It is governed by the following rules, applied automatically by our servers:

  1. Code and link: each account has a personal code and a speedyflow.app/r?code link, available in the app (Referral section, "Give a month"). You can share them by copying the link, by email, or via WhatsApp.
  2. Referee: a person who creates an account can enter a code in the app (Referral → Use a code) within 30 days of creating their account. They then immediately receive 1 month of Speedy Flow Pro.
  3. Referrer: the code holder receives 1 month of Pro for each referee who subscribes to the paid Pro plan. The reward is granted upon the referee's first successful payment. The free months given to the referee are not enough to trigger it.
  4. Cap: a referrer can earn a total of 12 months of Pro through the referral program.
  5. One code only: an account can use only one referral code, only once. You cannot use your own code.
  6. Effect of free months: they extend access to the Pro plan. If you already have a paid subscription, they are kept as credit and apply after your paid period ends. When they expire, without a subscription, the account returns to the Free plan, with no charge.
  7. No cash value: free months cannot be converted into cash, transferred to another account, or refunded, and cannot be sold or exchanged.
  8. Refunds: if you request or obtain a refund of a payment, the free months on your account are suspended as well. If the subscription of a referee who triggered the referrer's reward is refunded, that reward is canceled.
  9. Fraud: creating fake accounts, self-referral, using multiple accounts, posting codes on coupon sites in exchange for payment, or any scheme intended to obtain months artificially will result in cancellation of the rewards concerned and may justify suspension of the accounts involved (Section 17).
  10. Changes: the publisher may change the durations, the cap, or the terms of the program, or end it, going forward. The values in effect are displayed in the app and in this section. Months already granted remain yours, except in case of fraud or refund (see above).

The processing of data related to the referral program is described in the privacy policy: we never store the addresses of the people you invite.

11. Third-party services

The Service relies on third-party services: the operating system, transcription and writing engines, account hosting, Sign in with Google, payment providers, calendar, and the messaging apps used to share your link. Their availability and terms are the responsibility of those third parties. The publisher cannot be held liable for their failures, changes, or interruption, and may change providers to maintain the Service.

12. Availability, updates, and beta

The publisher strives to provide an accessible and reliable Service, without any guarantee of continuous or error-free availability. It may change, suspend, or withdraw all or part of the Service, in particular for maintenance, security, updates, or legal obligations. Some updates may be required to keep using the Service. Features presented as "beta," "preview," or "coming soon" are provided as is, may change or disappear, and carry no warranty.

13. Intellectual property

The software, the Speedy Flow brand, the logo, the interfaces, the text, and the graphic elements are the exclusive property of Otopcy LLC and are protected by intellectual property law. No rights are transferred to you beyond the license provided for in Section 7. You may mention Speedy Flow and share your referral link, without suggesting an official partnership or altering the brand. If you share suggestions or ideas with us, the publisher may use them freely, without any obligation to you.

14. No warranty

To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available," without any express or implied warranty, including of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Statutory warranties that cannot be excluded, in particular those owed to consumers, continue to apply.

15. Limitation of liability

To the fullest extent permitted by applicable law:

  • the publisher is not liable for indirect or consequential damages, such as loss of data, revenue, customers, opportunity, or reputation, or for the consequences of a transcription or rewrite that was not reviewed;
  • the publisher's total liability, for all causes combined, is limited to the amount you paid for the Service during the 12 months preceding the event giving rise to the claim, or to €50 if you use the Free plan or free months;
  • these limits do not apply in the case of gross negligence or willful misconduct, personal injury, or where the law of your country prohibits them.

16. Your indemnity

You agree to defend and indemnify the publisher against any claim, action, judgment, or expense, including reasonable attorneys' fees, arising from your use of the Service in breach of the Terms or the law, in particular from a recording made without the consent of the people involved.

17. Suspension and termination

You can stop using the Service at any time by uninstalling the app and requesting deletion of your account. A paid subscription is canceled in accordance with the Terms of Sale.

The publisher may suspend or terminate your access, limit a feature, or cancel free months in the event of a breach of the Terms, fraud (including referral fraud), non-payment, unlawful use, a security risk, or at the request of an authority. It will notify you in advance and tell you the reason, except in an emergency, where there is a risk of fraud, or where required by law. You can challenge the decision by writing to us. A suspension for breach of the Terms does not entitle you to a refund, to the extent permitted by law.

Sections 9, 13 to 16, and 19 to 22 survive the end of the relationship.

18. Compliance and sanctions

You agree not to use the Service in violation of applicable export control rules and international sanctions, or from a country or on behalf of a person targeted by such sanctions.

19. Force majeure

The publisher is not liable for a failure caused by an event beyond its reasonable control: a network or provider outage, a cyberattack, a natural disaster, a conflict, a decision by an authority, an epidemic, or a power or internet outage.

20. Governing law and disputes

If there is a disagreement, write to us first: we always seek an amicable solution, within 30 days at most. Failing that, the Terms are governed by the law of the country where the publisher is established, and the courts with jurisdiction over its registered office have jurisdiction. Consumers keep the protection of the mandatory rules of their country of residence and may bring proceedings before the courts those rules designate. Consumers in the European Union may also use a consumer mediator free of charge.

To the extent permitted by applicable law, each dispute is handled on an individual basis, and not as part of a class or collective action.

21. Changes

The publisher may update the Terms, for example to reflect a new feature, a change to the plans or the referral program, or a legal obligation. Significant changes are announced in advance in the app, by email if you have an account, or on the What's new page. Continuing to use the Service after they take effect constitutes acceptance; if you refuse them, you can stop using it and cancel your subscription at no cost.

22. General provisions and contact

  • Entire agreement: the Terms, together with the documents referred to in Section 1, form the entire agreement between you and the publisher regarding use of the Service.
  • Severability: if a provision is held invalid, the others remain in effect.
  • No waiver: failing to enforce a right does not constitute a waiver of that right.
  • Assignment: the publisher may assign the agreement to a company that takes over the Service; you may not assign your rights without its consent.
  • Language: in the case of a translation, the French version prevails.
